Why Your Business Needs a Specific Waiver

Under the Animal Welfare Act 2006, you have a legal duty of care to animals in your facility. A waiver does not allow you to bypass this law, but it does protect your business by documenting that the owner has disclosed all relevant health and behavioral information.

Essential Clause 1: The Matting Policy

In the UK, “de-matting” can often lead to pain or skin irritation, which could be seen as an offence under welfare laws. Your waiver must include a clause giving you permission to shave-off a matted coat if it is in the best interest of the dog’s comfort.

Essential Clause 2: Emergency Vet Consent

Your agreement should explicitly state that in the event of an emergency, you are authorised to seek veterinary treatment. It should specify that the owner is responsible for all associated costs unless the injury was a direct result of negligence.

  • Physical Assessment: Check for existing lumps, bumps, or skin issues in front of the owner.
  • Behavioral History: Document any history of biting, aggression, or severe anxiety.
  • Grooming History: Confirm when the dog was last groomed and how they reacted.

In the UK pet industry, a waiver is often misunderstood as a “get out of jail free” card. Legally, you cannot waive away negligence or your responsibilities under the Animal Welfare Act. Instead, a professional waiver serves as an informed consent document.

Three Non-Negotiable Clauses

1. The Shave-Off Policy: Explicitly state that if a dog is severely matted, you will prioritise welfare over aesthetics. This protects you if an owner is unhappy with a short clip that was medically necessary.

2. Pre-existing Conditions: Ensure the owner signs off that they have disclosed all lumps, bumps, or heart conditions. This prevents “new” injuries being blamed on the groomer.

3. Emergency Authorisation: You must have written consent to seek veterinary care if the owner is unreachable. This clause should state the owner is liable for costs.
